Inquiries and Emails

Inquiries and training registrations sent to MarkRiordan.com, JMarkInc.com, JMarkConsulting.com and other linked websites, all owned by Mark Riordan and used for the promotion of Mark Riordan and his company, JMark Consulting Inc., require you to provide JMark Consulting Inc. with personal details that may include name, address, telephone numbers and emails.  These items will be sent to us in an email and will also be retained on our server.  However, we won't share any of this information with anyone except for our employees and necessary contractors and to others only under certain extraordinary circumstances described below.

Inquiries that arrive at the inbox of JMark Consulting employees will have some or all of the personal information described above.  JMark Consulting retains most of the email messages received, therefore your personal information will likely remain on record in email archives.  These archives are stored on servers owned by third-party providers contracted to JMark Consulting Inc. and are only as reasonably secure as email servers are in general.  These archives may also be retained on computers owned by Mark Riordan and by JMark Consulting inc. and reasonable, though non-published, methods are in place to physically secure said computers.

Financial information such as credit card information for payment to JMark Consulting Inc. is required to be handled by fax, postal mail, or by telephone thus insuring that such transactions are outside the Internet realm, and are not subjected to this privacy policy.  Please do not send such information by unencrypted email as its privacy and security cannot be reasonably assured.

Cookies

These websites may use cookies to record your log file.  Cookies are small text files placed automatically on your hard drive by your web browser when you visit certain websites in order to make those sites easier to use.  You can configure your browser to disable cookies and/or to alert you when new ones are being sent, but some features of our sites may not work properly if you do so.

Disclosure

JMark Consulting is licensed by the Texas Board of Private Security and is bound by the privacy requirements of the Texas Private Security Act, Sec. 1702.133, which states:

CONFIDENTIALITY; INFORMATION RELATING TO CRIMINAL OFFENSE.AA(a) A license holder or an officer, director, partner, or manager of a license holder may not disclose to another information obtained by the person for an employer or client except:
(1) at the direction of the employer or client; or
(2) as required by state law or court order.
(b) A license holder or an officer, director, partner, or manager of a license holder shall disclose to a law enforcement officer or a district attorney, or that individual's representative, information the person obtains that relates to a criminal offense.

According to our interpretation of the above law, which we are bound to abide by, we reserve the right to disclose your personal information in the following two extraordinary circumstances: (a) If we believe, in good faith, that we are required to do so by the above law, or (b) if we believe in good faith that such disclosure is necessary to defend our website's infrastructure or legal rights.  We assume, upon receipt of your emailed inquiry or registration information that you agree to these privacy terms.

Threatening and/or Abusive Communications

Notwithstanding the foregoing provisions, we reserve the right to collect, disclose, and/or publicize personal information about anyone who sends a threatening or abusive communication, in any format or by any medium, to us or any of our employees, contractors, or family members.  We will not honor requests for privacy attached to any such communications, notwithstanding those emails which are governed by the above Texas Private Security Act statute.  Please rest assured that any and all of these type communications will be investigated fully both by JMark Consulting Inc. and by the appropriate law enforcement agency and criminal charges will be pursued vigorously.

Opt-out, Opt-in

Training bulletins, flyers, notices, and newsletters are often sent by email to clients and to persons inquiring at our websites, and by your registration and training inquiry to JMark Consulting Inc., you are deemed to have given permission to receive these periodic bulletins.

Inquiries for Forensic Hypnosis, Due Diligence, and Private Investigation services will not be added to our email list for training flyers unless you specifically ask in your email.

Should you desire to not receive these bulletins, flyers, notices and newsletters, indicate so in your inquiry email or on your registration form or send an email from each email account receiving the bulletins to Mark@JMarkInc.com with TRAINING NOTICE OPT-OUT in the subject line.  You do not need to put anything further in the subject line or body of the email.  You will be removed from our email list.

Should you desire to OPT-IN, or receive such training flyers, and you are not on our current email list, please send an inquiry from the training inquiry link stating you would like to be added to our mailing list.

Miscellaneous

This privacy policy applies to MarkRiordan.com, JMarkInc.com, JMarkConsulting.com and other websites owned by Mark Riordan and JMark Consulting Inc., and does not apply to any websites to which we link, or to any other third party.  For information about a third party's privacy policy, please consult its individual website.

This privacy policy may be revised from time to time without prior notice.  Please check this page periodically for updates.  Your use of our sites on any given date indicates your acceptance to the terms of this policy as of that date.
